WHO WE ARE

SAPD attorneys and staff come from diverse backgrounds, but all are bound together by a common commitment to service. At its most abstract, that service entails vigorous defense of the protections afforded by the United States and Idaho Constitutions, as those protections are the cornerstone of a free society. But on a more tangible level, the SAPD’s service means standing between the government, with its awesome power and seemingly limitless resources, and vulnerable individuals.

While the SAPD represents clients in everything from low-level misdemeanor to capital murder cases, we understand that no matter the case type or sentence, the case at hand means everything to the affected client. Every arrest and criminal charge is traumatic. Every conviction carries serious direct and collateral consequences. And every minute of incarceration is a minute too long. Thus, every client is important to us, and we take each case seriously.

We can never guarantee any particular outcome, but what we can do is promise to give each case the care and attention it deserves, and to bring our considerable skill and experience to bear to give every client the best possible chance of success.

The SAPD strives to provide superb representation to all of its valued clients. Its attorneys are among the most experienced and highly skilled appellate and capital attorneys in Idaho. They work tirelessly to protect their clients’ rights and ensure fair outcomes. The SAPD recognizes and celebrates the humanity of each client by treating them with dignity and respect while giving them a voice in a legal system that can otherwise make them feel unheard and powerless. 

The SAPD’s mission is, “Defending zealously, advancing fairness, and advocating with integrity.”

The SAPD’s vision is, “A better Idaho where the legal system treats each person with fairness and dignity.”

A QUARTER CENTURY OF EXCELLENCE

The Idaho State Appellate Public Defender’s Office (SAPD) was created in 1998 to provide skilled counsel to those convicted of crimes, and to do so in a fiscally responsible manner.  

Over the years, the SAPD has not only grown in size to meet its caseload needs, but it has matured as a law office. The SAPD currently has eight attorneys with 10+ years of criminal appellate experience, including four attorneys with 20+ years of criminal appellate experience. The SAPD employs some of the best, most experienced appellate and death penalty lawyers in the State of Idaho.

The SAPD’s appellate practice is regularly held up by judges and other lawyers as an example to be emulated.

For example, former Idaho Supreme Court Chief Justice Roger Burdick once advised a defendant in a criminal case: “If you are going to appeal, I would suggest strongly that you allow the services of the State Appellate Public Defender. Some of the best appellate lawyers I ever had practice in front of me in my 18 years on the Idaho Supreme Court.” Sentencing Hearing Transcript, State v. Chadwick Martinez, Ada County No. CR01-21-37566 (Feb. 17, 2023).

Likewise, in a 2023 interview, when asked what advice she would give to an attorney preparing for his or her first appellate argument, Justice Robyn Brody of the Idaho Supreme Court said she would advise attorneys “to watch other oral arguments – particularly the State Appellate Public Defenders and the Deputies Attorney General who appear frequently before the appellate courts.  They really understand what appellate advocacy is and have a rhythm with the court. I think their arguments are very well done and would help any attorney navigate an appellate argument.” Sarah Tompkins, An Interview with Justice Robyn Brody, The Advocate (Mar. 2, 2023).

After successfully improving the standard of appellate practice for criminal defendants in Idaho, the SAPD served as a model for creation of a statewide trial-level public defense office. That office opened its doors in late 2024.

The SAPD is now proud to be involved in helping to develop the next generation of appellate lawyers. In 2025, it began partnering with the University of Idaho College of Law’s Appellate Clinic, whereby third-year law students gain critical practical experience working on SAPD cases under the close supervision of SAPD attorneys and law school faculty.

MEET THE DIRECTOR

Erik Lehtinen obtained his undergraduate degree from Cornell University in 1996 and his law degree from the College of William & Mary School of Law in 2000.

Immediately after graduating from law school, Erik moved to Boise. He wanted to practice law someplace where, during his time off, he could enjoy big mountains and wide-open spaces. He was quickly admitted to practice law in Idaho, and he began his legal career practicing civil litigation at one of Idaho’s oldest, largest, and most well-respected firms.  

In 2004, Erik left private practice and joined the SAPD as a Deputy State Appellate Public Defender. He found his calling. Erik firmly believes that faithful adherence to the rule of law is critical if we are to have a free and equal society. Thus, the only thing more rewarding to him than being able to fight for the protections guaranteed to us all under the United States and Idaho Constitutions is being able to do so on behalf of so many wonderful clients, each with their own unique story and personality.    

After working for nearly a decade as a Deputy State Appellate Public Defender, Erik became the Chief of the SAPD’s Appellate Unit. In that new role, he supervised a team of up to twelve brilliant and dedicated attorneys who handled a wide array of felony direct and post-conviction appeals.

On January 7, 2024, Governor Brad Little appointed Erik as the State Appellate Public Defender. His appointment was confirmed by the Idaho Senate on February 1, 2024.
